Joanna Smith QC (Wilberforce Chambers) appeared for the claimant Fund seeking damages in professional negligence against the defendant solicitors firm.
The Fund (by now in liquidation) claimed it had relied on a certificate of title prepared by Hewetts in authorising a drawdown of funds to enable purchase of a long leasehold interest. It claimed to have suffered a £800,000 loss.
Issues in dispute included the scope and extent of the solicitors' duty of care (where it was common ground that the fund never retained the solicitors); whether a breach had occurred; causation; recoverability and foreseeable damages; contributory negligence; and appropriate rates of interest to be paid on damages (if any).

reached and their implications, and practical lessons.
